Construction Noise NYC: Hours, Variances and What You Can Do

Jackhammers at 7 a.m. Concrete pours at night. If you live in New York, construction noise is part of life. Still, the city has clear rules about when work can happen and what contractors must do to limit noise. Knowing those rules helps you tell normal construction noise in NYC from a violation, and it shows you what to do about each.

How Big Is the Construction Noise Problem?

It is big, and it grew fast. Construction noise complaints to 311 rose from 14,259 in 2010 to 37,806 in 2015, according to an audit by the New York State Comptroller (Office of the NYS Comptroller, 2017). In addition, about 74 percent of the complaints the audit reviewed involved work outside permitted hours.

Construction Noise NYC Rules: When Work Is Allowed

The basic rule is short. Construction is allowed from 7 a.m. to 6 p.m. on weekdays. Any other time, including weekends, needs after-hours authorization (NYC DEP Construction Noise Rules).

Beyond hours, every job also needs a plan:

  • Noise mitigation plan. Anyone doing construction must have a Construction Noise Mitigation Plan before work starts, and a copy must be kept on site.
  • After-hours work. An after-hours permit from the Department of Buildings or Department of Transportation requires that plan.
  • Alternative plans. If a contractor cannot meet the standard plan, it must file an Alternative Noise Mitigation Plan and wait for approval.
  • Posted contact sheet. Contractors should post a Construction Noise Contact Sheet on the site fence.

How to Check if Night Work Is Permitted

Before you call, check whether the site has a variance. The Department of Buildings publishes a list of active after-hours variances (DOB Active After Hours Variances). If the address has a current variance, the work may be legal, although the contractor must still follow its noise plan.

What You Can Do About Construction Noise in NYC

  1. Document it. First, note dates, times and what you hear. Short phone videos help.
  2. Check the fence. Next, look for the posted noise contact sheet and call the contractor directly.
  3. Report it. If work happens outside allowed hours without a variance, call 311 or file online.
  4. Talk to your building. If the work is inside your building, your board or management can enforce the alteration agreement.

Be realistic, though. The audit found inspectors often arrived after the noise stopped. Because of that, good records matter more than one angry call.

Protecting Your Home During a Long Project

Big projects can last for years, and construction noise in NYC rarely stops at the property line. If a tower is going up next door, enforcement alone will not make your home comfortable. In that case, consider these upgrades:

  • Interior window inserts on the side facing the site.
  • Sealing AC sleeves and vents that face the work.
  • A decoupled wall upgrade for a bedroom that shares a wall with the site.

Vibration from demolition and pile driving can also travel through the ground. If you feel it, read our guide to structure-borne noise.

For Owners and Contractors

If you are renovating, plan for construction noise in NYC from day one. Neighbors who know the schedule complain less. Likewise, quieter tools, sound blankets and smart sequencing reduce both complaints and fines. Hush also helps commercial clients plan quieter fit-outs. See our commercial soundproofing services.
